Terms & Conditions
1. DEFINITIONS
“Client” / “you” / “your” means the individual, company, or other legal entity making the booking, including all persons named on the booking and any additional participants added or substituted at a later date.
“Company” / “we” / “us” / “our” means Pink Monkey Stag and Hen Ltd, trading as Activities In Portugal, with registered office at 49 Station Road, Polegate, BN26 6EA, UK.
“Supplier” means any third-party company or individual engaged by us to provide activities, accommodation, transport, catering, or any other services on our behalf.
“Representative” means any employee, contractor, or agent of the Company or of a Supplier.
“Services” means the activities, events, or related arrangements booked with or through us.
2. CONTRACT FORMATION – Website Bookings
2.1 When you make a booking through our online booking platform, using our payment calendar system, a binding contract is formed between you and the Company at the time you complete the booking process and submit payment authorisation. This is the case regardless of whether the booking is subsequently confirmed or cancelled.
2.2 Upon completion of the booking process, our system will place a hold on your payment for up to seven (7) calendar days. During this hold period, we will review and either:
Confirm the booking, in which case the payment will be captured and processed; or
Cancel the booking, in which case the payment hold will be released in accordance with your card issuer’s processing times.
2.3 Beyond the seven (7) day hold period, the Company has no control over or access to the held funds, as the payment will be managed directly by your bank or payment provider.
2.4 In the absence of a signed physical document, you acknowledge and agree that completion of the booking process on our website, together with automated confirmation via our system or by email, constitutes a valid and legally binding agreement under these Terms.
2.5 You are solely responsible for ensuring that the booking details entered in our online system — including dates, times, participant numbers, and activity selections — accurately reflect your requirements. Any errors or discrepancies must be reported to us in writing within 24 hours of booking. Failure to do so may result in additional charges and/or an inability to amend your booking.
CONTRACT FORMATION Corporate Activities
2.1.1 A binding contract is formed between you and the Company upon our written confirmation of your booking request (including confirmation via email) and receipt of any required deposit or full payment.
2.2 In the absence of a signed document, you acknowledge that confirmation by email constitutes a valid and legally binding agreement under these Terms.
2.3 You are responsible for ensuring the Booking Confirmation accurately reflects your requirements. Any discrepancies must be notified to us immediately.
PRICING & PAYMENT
3.1 All prices are quoted in Euros (€) and are inclusive of VAT unless otherwise stated.
3.2 Corporate Venue / Meeting Room Bookings
We provide complimentary venue search services. Our fees range from 5% to 15% depending on the booking. Two invoices will be issued:
One for direct payment to the venue.
One for our service fee.
3.3 Team Building Activities
Our fee is included in the advertised price unless otherwise stated.
3.4 Online Payments
Payments are authorised at the time of booking but only captured after supplier confirmation. If an activity cannot be confirmed, the booking will be cancelled and no funds will be taken.
3.5 Payment Terms
Unless otherwise agreed in writing:
Deposits are non-refundable.
Failure to pay on time constitutes a breach of contract and may result in cancellation without refund.
4. CANCELLATIONS & AMENDMENTS
By You
4.1 All cancellations must be in writing. Cancellation charges apply as follows:
Activities Only
0–60 days before event: 100% payable.
More than 61 days: Loss of 10% of payment.
Corporate Events
0–61 days before event: 100% payable.
More than 60 days: Loss of deposit.
4.2 Reductions in participant numbers will require a price recalculation and may be treated as a partial or full cancellation.
4.3 Card processing fees are non-refundable.
Activities Only
0-60 days before travel date – 100% Payable of the total price
More than 61 days before travel date – Loss of 10% of payment
Card processing fees are not refundable
Excursions or other tours that you may choose to book or pay for directly with suppliers are not part of the package provided by us, we are not responsible for these payments.
By Us
4.4 We reserve the right to amend or cancel any Service due to reasons beyond our control.
4.5 If cancellation is necessary, we will offer an alternative of equal value (where available) or refund amounts paid, excluding non-refundable costs.
4.6 We are not liable for any consequential losses, travel expenses, or other costs arising from changes or cancellations.
In rare instances, we may be compelled by ‘force majeure’ to modify or terminate any part or the entirety of your booking, either immediately before or after departure. Should such a situation arise, no refunds will be issued unless we are able to secure refunds from our suppliers. Additionally, we cannot provide compensation or cover any costs or expenses incurred by you as a result of such changes.
We also retain the right to withhold a fee of 25 euros to cover the costs charged to us by our card payment supplier and other administrative expenses when refunds are issued due to cancellations by the supplier
5. FORCE MAJEURE
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to: war or threat of war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, virus, fire and all similar events outside our control.
6. CLIENT CONDUCT & INDEMNITY
6.1 You are responsible for the behaviour of your group and any damage caused. You must indemnify us against any claims, costs, or losses arising from such behaviour.
6.2 We reserve the right to terminate Services without refund if you or any participant behaves in a way that, in our reasonable opinion, causes or is likely to cause danger, nuisance, or distress to others.
6.3 If your behaviour results in loss of a supplier relationship, you agree to pay a minimum of €2,000 compensation per affected supplier.
7. LIABILITY
7.1 We act as an agent for third-party suppliers and accept no liability for their acts, omissions, or negligence, except where required by law.
7.2 To the fullest extent permitted by law, our total liability to you is limited to the amount paid for the relevant Service.
7.3 You acknowledge that certain activities carry inherent risks. Participation is voluntary, and you accept those risks.
8. LATE ARRIVALS & DELAYS
You are responsible for arriving on time at the designated meeting points. We are not liable for missed services due to late or non-arrival, and no refunds will be issued.
9. PASSPORTS, VISAS, HEALTH & INSURANCE
You are solely responsible for ensuring you meet all passport, visa, and health requirements. We strongly recommend obtaining comprehensive travel insurance covering all booked activities.
10. ADVERSE WEATHER
In the event that your scheduled activity must be canceled on the day due to safety precautions related to adverse weather conditions:
If the supplier is compelled to cancel the activity and is unable to provide any alternative, you are entitled to an 80% refund.
If the supplier is able to partially offer the activity by removing elements that pose health and safety concerns, Pink Monkey Stag and Hen Ltd, trading as Activities In Portugal, will not refund any costs.”
11. COMPLAINTS
Complaints must be reported immediately to the supplier during the event. If unresolved, you must notify us in writing within 28 days of return. Complaints received after this will not be considered.
12. MISCELLANEOUS
Severability: If any provision of these Terms is found invalid, the remaining provisions remain enforceable.
Entire Agreement: These Terms constitute the entire agreement and supersede all prior discussions or representations.
No Waiver: Failure to enforce any provision does not constitute a waiver of rights.
